1. Agreement to Terms

By accessing or using the Hexara website at https://www.hexara.io ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

These Terms apply to all visitors and users of the Site, including those who submit their email address to join our waitlist.

2. Description of Service

Hexara is an AI-powered mesh generation platform currently in research and development. The Site is currently operating as a pre-launch waitlist. By joining the waitlist, you are expressing interest in being notified when the Hexara platform becomes available. Joining the waitlist does not guarantee access to the platform or any specific features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. Eligibility

You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Waitlist & Communications

By submitting your email address to join the Hexara waitlist, you agree to:

• Receive email communications from Hexara regarding our launch, product updates, and related announcements.
• Allow us to store your name and email address for the purposes described in our Privacy Policy.

You may opt out of these communications at any time by clicking the unsubscribe link in any email we send, or by contacting us at areenpatil@gmail.com.

5. Intellectual Property

The Site and its original content, features, and functionality — including but not limited to text, graphics, logos, and software — are and will remain the exclusive property of Hexara and its licensors. You may not reproduce, distribute, modify, or create derivative works of any content on the Site without our prior written consent.

6. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Site or its related systems.
• Transmit any harmful, offensive, or disruptive content through the Site.
• Use automated tools to scrape, crawl, or extract data from the Site without our prior written permission.

7. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Hexara does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content on the Site.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Hexara and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site. In no event shall our total liability to you exceed the amount you have paid to us in the past twelve (12) months, or $0 if no payments have been made.

9. Dispute Resolution

Informal Resolution. Before filing a formal claim, you agree to first contact us at areenpatil@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Arbitration. If the dispute cannot be resolved informally, both parties agree to resolve any claims through binding arbitration in the United States, rather than in court, except that either party may assert claims in small claims court. You waive the right to a trial by jury and to participate in any class action.

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any litigation that proceeds in court shall take place in Oregon.

Time Limit. Any claim arising from or relating to these Terms must be filed within one (1) year after the cause of action arises, or it is permanently barred.

10. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by sending an email to the address you provided when joining the waitlist. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
